Orange County Health Facilities Authority

Purpose

To assist not for profit health facilities in the acquisition, construction, financing, and refinancing of qualified projects in Orange County, Florida, and elsewhere subject to satisfaction of applicable law.

Board

Appointing Authority: Appointments to the Orange County Health Facilities Authority are made by the Orange County Board of County Commissioners pursuant to Florida Statutes Section 154.207(4).

Term Length: 4 Years, but members serve until a successor is appointed and has qualified per Florida Statutes Section 154.207(4).

Creation Documents

The Orange County Health Facilities Authority was established by Orange County Ordinance No. 77-13, adopted December 20, 1977, pursuant to the Health Facilities Authorities Law, being Part III of Chapter 154, Florida Statutes. The Ordinance was amended on July 10, 1979, by Ordinance No. 79-17. The Orange County Health Facilities Authority operates pursuant to the same “Health Facilities Authority Law”, being Part III of Chapter 154, Florida Statutes. Boundaries

The Orange County Health Facilities Authority assists not for profit health facilities located within the geographical limits of Orange County, Florida, primarily through providing tax exempt bond financing for their health facility projects located in Orange County. Pursuant to Section 154.247, Florida Statutes, the Authority may, if it finds that there will be a benefit or a cost savings to a health facility located within its jurisdiction, issue bonds for such health facility to finance projects for such health facility, or for another not-for-profit corporation under common control with such health facility, located outside the geographical limits of the local agency or outside this state.

Assessments

The Orange County Health Facilities Authority does not assess any taxes, fees, or assessments, but does charge to and equitably apportion among benefitted health facilities its administrative costs and expenses incurred in exercising its powers pursuant to Section 154.209(4), Florida Statutes.

Code of Ethics

The Orange County Health Facilities Authority is an “agency”, and its members are “public officers” subject to the “Code of Ethics For Public Employees and Officers” set forth in Part III of Chapter 112, Florida Statutes.
